Rosters and Hours of work in Restaurants

Over the last month several issues have been raised with Unite organisers regarding security or hours and roster protocols, the following is a summary of what your contract says about these important issues.




McDonalds

  • You can increase your availability at any time, in writing and your store management should use their best efforts to provide your desired hours.

  • You will be paid at least 3 hours for any shift
  • You will not be required to work more then 2 shifts per day, 8 hours per day or 40 hours per week unless you agree to this with your manager.
  • You will not be required to continue work after 12 hours from your original start time on any day, on a 6th or 7th day in a week, or without a break of 9 hours between your finishing time on one day and your starting time another day unless you agree to this with your manager.
  • When additional hours are available in your store existing staff will be given first consideration to take up these hours
  • Decreased hours available in a store will lead to an equal loss of hours throughout all crew in a store.

KFC-Pizza Hut-Starbucks

  • Minimum shift of 3 hours or 1 hour at staff meetings

  • 2 Hour minimum shift can be agreed to in Pizza Hut under exceptional circumstances
  • Rosters should be posted at least 7 days in advance of the working week commencing and once posted cannot be altered unless by mutual agreement this includes starting and finishing times AND length of unpaid breaks
  • Additonal hours available will be offered to existing staff members before new staff are hired to fill the time
  • Overtime will ne paid at a rate of 1.5 the normal hourly rate for shifts more then 8 hours, if a working week exceeds 40 hours or if time between 2 shifts is less then 9 hours – overtime can be waived by mutual agreement between you and your manager.

Wendys

  • Additional hours available in restaurants will be offered to existing staff before new staff are employed to fill the position

  • Members of Unite with 3 years service or more and entitled to a guarantee of 30 hours per week providing they have open availability.
  • Variation to your available hours must be agreed on my yourself and the manager.
  • No employee will be paid less then 3 hours per shift worked unless by mutual agreement.
  • For an official meeting or training session a 1 hour minimum applies.

Burger King

  • Minimum on 2.5 hours pay for any shift worked.

  • More than one shift per day will only be given if the beginning of the 1st and end of the 2nd shifts fall within 12 consecutive hours of each other.
  • For split shifts or 2 shifts in a day you will get a 2 dollar allwance per day (which is better than nothing).
  • If 5 days work has been done in a week and your manager asks you to work on the 6th or 7th days you are entitled to 1.25 your regular pay.
  • If you ask to work the 6th or 7th day you will be pain as usual
  • Rosters posted at least 5 days in advance.
  • Back to back shifts by mutual agreement only.
  • Your managers have a responsibility to provide you with as close to your requested number of hours as is realistically possible.
  • When hours become available management will offer these first to fully effective members up to 40 hours per week.

Important note for all brands

  • Nothing in any of our agreements should present you from working more then 40 hours per week or being paid for all the hours you work at the full rate each week.

  • Often store management does not know about some of these rules or do not want to give you the minimum requirements, it is important that you are aware of what rights you have.
